ABOUT RECONCILIATION

CHAPTER 1

General rules applicable to ordinary conciliation.

Act 446 1998

Article 64. Definition. Conciliation is a conflict resolution mechanism through which two or more people manage themselves resolve their differences with the help of a neutral and qualified third party, known as a conciliator.

Article 65. reconcilable Affairs. Be reconcilable all matters susceptible transaction, withdrawal and those expressly provided by law.


Article 66. Effects. The settlement does res judicata and the conciliation provides executive merit.


Article 67. Classes. The reconciliation may be judicial or extrajudicial. Institutional conciliation court will be when performed in conciliation centers; administrative when performed before administrative authorities in compliance with its conciliatory functions; and equity when performed before equity conciliators as provided in this law.

As an alternative mechanism for conflict resolution that has been widely implemented by the state. The reconciliation represents a means for dispute settlement that requires less investment of time and money, is now a prerequisite to commencing most court proceedings.


Act 640 2001

This Act empowered notaries for extrajudicial conciliation.

Article 19. RECONCILIATION. They may reconcile all materials that are capable of compromise, withdrawal and reconciliation, before the conciliators conciliation centers, to public servants empowered to conciliate the terms of this Act and to notaries.
